Amendment to the National moot Problem
In response to the queries made regarding the National Problem of the Odd Semester Grand Intra Moot 2012-2013, following corrections and clarifications are being made:
AMENDMENT TO STATEMENT OF FACT AND CASE OF PETITIONER
1. Subsequent to the criminal complaint, the petitioner also instituted a civil suit against Mr. Ramnath and his family in the district court, Gurgaon. The petitioner claimed declaration in regards to following issues:
a. That the sale agreement, GPA and the Will made in its favour are valid and the cancellation of the same by the respondent has no legal justification.
b. That the consideration for Rs. 45 lacs paid to the respondent for the land and the subsequent possession of the same by the petitioner deprives the respondent from any authority to make future transaction regarding the said land.
c. That the non-payment of balance amount on time does not per se render the original transaction void as the petitioner was willing to pay the same.
The district court after taking the cognizance of the case dismissed the petitioner’s suit. The petitioner then filed an appeal against the same in the Punjab & Haryana HC. The HC after going into the merits of the case also dismissed the same. The petitioner has now filed an SLP [SLP No. 121 of 2012] against the said order of Punjab & Haryana HC claiming that same involves a substantial question of law and that the failure of both the district court and the HC to appreciate the questions of law involved amounts to grave injustice.
2. The appeal against the decision [i.e. the contradictory statements made in relation to the status of investigation] by the concerned ‘public authority’ to petitioner’s RTI application was not filed before the CIC, Rajasthan but before the CIC, Haryana.
3. The docket no. of SLP against the order of Punjab and Haryana HC in relation to the decision of the CIC, Haryana is SLP No. 101 of 2012.
4. The hon’ble Supreme Court combined the two SLPs [SLP No. 101 of 2012 and SLP No. 121 of 2012] and has decided to hear them together.
