Amity Quiz on Constitutional Law 2012

Amity Law School, Noida organized Amity Quiz on “Constitutional Law”, the first ever competition of its kind, at Amity Campus, Sector-125, Noida

The Prize Distribution Ceremony of the Quiz was graced by the Chief Guest Hon’ble Mr. Salman Khurshid, Union Minister for Law & Justice, Guest of Honor Mr. K.T.S. Tulsi, Senior Advocate and Vice Chairman Law Commission of India, Hon’ble Mr. Justice A.K. Sikri, Acting Chief Justice, Delhi High Court and Mr. Atul Chauhan- Chancellor, Amity University, Uttar Pradesh.

Welcoming all the distinguished guests and participants, Maj Gen. (Retd.) Nilendra Kumar- Director, Amity Law School, Noida dwelt on the objective of organizing the Quiz and presented a brief report about the Quiz.

The Chief Guest, Hon’ble Mr. Salman Khurshid, Union Minister for Law & Justice, Govt. of India applauded the ambience, quality of students and faculty members at Amity Law School and expressed his concern as to why for so many years the same kind of quality campus life is not being provided in other Law Institutes across the country. Talking about the multiple roles played by the judges and the challenges faced by them, the Honorable Minister said, “A judge is incredible product of human nature, a judge has to understand language, emotions, compassion, discipline and firmness, he has to be a creator of goodness as well as a destroyer of evil. A Judge has great challenges especially those of democracy because there is a separation of powers in the country and at the same time, there are politicians who are accountble to voters and political system but politicians have been told that they have areas where they can operate, the judges have an area where they operate and the legislature has its own area where it can operate. The important thing is how to decide where to draw the line and this ultimately has to be decided by the person who adjudicates ie the Judge. There are healthy tensions that exist in the area of separation of powers, between the judges and the members of executive but finally the last word lies with the Judge because they are the ones who finally speak what the Constitution actually means”.

Sharing his views on “Constitutional vision of the Justice” , Hon’ble Mr. Justice A.K. Sikri, Acting Chief Justice, Delhi High Court called upon the budding lawyers to cherish the value of freedom and liberty along with fundamental rights and duties because when they will join the Law profession, they have to enforce and uphold these values, rights and duties. He advised the students to always consider the rule of law supreme and motivated them to ensure that the Justice delivered is fair and timely.

Addressing the students, Mr. Atul Chauhan- Chancellor, Amity University, Uttar Pradesh congratulated them for their enthusiastic participation in the Quiz. He called upon the students to make the best out of the experiences they have gained during the quiz and stressed that their future will rest on how much they can learn and implement out of those experiences.

Mr. K.T.S. Tulsi, Senior Advocate and Vice Chairman Law Commission of India shared his views on the execution of death sentence and referred to the delay in the execution of death sentence as “Cruel, Inhuman and Unconstitutional”. He stressed that death penalty is the severest form of punishment awarded in rarest of the rare cases but there are challenges in the execution of the rarest of the rare punishment and the biggest challenge is the delay in the execution of death sentence, which is even worse than death. He expressed his concern over the laxity shown by Supreme Court in administering death sentence by referring to several judicial cases wherein with the passage of time the rules seem to be getting relaxed.

The event saw the participation of 180 law students pursuing five years and three years Law courses from 42 leading law colleges in the country including Delhi University, IP University, NLU Orrisa, RML NLU Lucknow, GNLU, Gandhinagar, RGNLU Patiala, NLIU Bhopal, Army Institute of Law, Mohali, Amity Law School, Delhi, Vivekanand Institute of Professional Studies (VIPS), KIIT School of law, KIIT University, NALSAR, K C Law College Mumbai, Deccan Education Society Law College amongst others.

The quiz comprised of high grade multiple choice questions numbering 100 to be answered in 90 minutes. The questions were based on the provisions of Constitution of India and the cases decided by the Supreme Court as reported in law journals till 31st December 2011.

Attractive cash prizes and medals named after eminent jurists were awarded to the winners. The First Prize titled as “Nani Palkhivala Award” comprising of a Medal and Rs. 50, 000 cash went to John Mathew from Faculty of Law, Delhi University, Second Prize titled as “ Homi Seervai Award” went to Navneet Krisna from NLU, Orrisa, Third Prize titled as “ B R Ambedkar Award” was lifted by K Suresh from GNLU, Gandhinagar and an Exclusive Prize for the host Institute titled as “Justice H R Khanna Award” was bagged by Avinash Kumar from Amity Law School, Noida.

Greetings from the Director

The successful culmination of AQCL was a historic and super acheivement. The feedback from the dignitaries, invited  guests, Chancellor and VC were all positive and laudatory. So were  the comments of the participants.  The actual quiz, cultural program, prize distribution function. souvenir, food,accomodation,registration, guest care, reception,class arrangements and accounts together with everything else were all of requisite standard.Such a feat could not have been attained but for the wholehearted support of faculty, staff and student  coordinators and volunteers.Also it was creditable for ALS N participants to register. My compliments and thanks to all of you. Pl keep up the name of ALS, Noida.

NLIU International Mediation Competition 2012


The Alternative Dispute Resolution Cell (ADRC) at the National Law Institute University (NLIU), Bhopal, would like to cordially invite your prestigious institution for the upcoming 2012 NLIU International Mediation Competition.



NLIU has had a long association with International Academy Alternative Dispute Resolution (INADR), a leading international organization on mediation. As part of this association, INADR will hold a capsule training session for all the teams before the start of the Competition. Amity Law School, Noida has organized Amity Quiz on Constitutional Law, the first ever competition of this kind being held any where in the country on Friday, 24th August 2012.  The event, open to law students of five years and three years courses, will have a high grade quiz test of multiple choice questions numbering 100 to be answered in 90 minutes.

The questions will be based on the provisions of Constitution of India and the cases decided by the Supreme Court as reported in law journals till 31stDecember 2011.  Attractive cash prizes and medals named after eminent jurists, Nani Palkhivala, Homi Seervai, B R Ambedkar and Justice H R Khanna will be awarded to the winners.

Sports Competition Program for - FRESHERS


Honorable Founder President is very keen that students of Amity University should participate in around the year program of Sports and Sports Competitions for improving their sports skills as well as for promoting Physical Fitness and Wellness among the students.

The Acting Vice Chancellor has specifically desired that ASPESS should organize Inter- Institutional Sports Competitions only for the newly admitted students (Academic year 2012-13). It has been decided to hold these competitions towards the end of August 2012 that is the time by which admissions in all the Institutions would be more or less completed. These competitions would facilitate in identifying potential among the FRESHERS in different games and sports and will in turn help different Institutions in forming their teams for SANGATHAN & SPARDHA and also help Amity University in identifying sportsperson for Inter University Competitions.

It is proposed to organize Inter-institutional Sports Competitions only for the newly admitted students of the current academic year in the following sports disciplines.

The Whitney R. Harris World Law Institute at Washington University School of Law Essay Competition


The Whitney R. Harris World Law Institute at Washington University School of Law seeks submissions of essays for the Benjamin B. Ferencz Essay Competition, held on the occasion of the Tenth Anniversary of the International Criminal Court.

ELIGIBILITY AND REQUIREMENTS

  • Contestants must be 20 years of age or older.
  • Contestants must have completed their high school studies.  Law students, PhD students and young scholars are especially invited to apply. 
  • The essay must be written solely by the candidate. 
  • The essay should take the form of a law review style article. 
  • Submissions must be original and unpublished works of under 6,000 words, including footnotes. 
  • Footnotes must conform to authoritative standard rules of legal citation and must include a description of each authority adequate to allow a reasonable reader to identify and locate the authority in a publication of general circulation.
  • The essay must be typed and double-spaced.

AWARD

The first-place winner of the Essay Contest will receive an award of US$10,000.  Second- and third-place runners-up will each receive an honorable mention and a plaque as well as runner-up awards in the amount of US$2,500 each.  The first-place winner of the Contest will be invited to St. Louis, Missouri, for an award ceremony that will take place during the International Criminal Court at Ten conference in November 2012. The essay will be included in the symposium issue published by the Washington University Global Studies Law Review resulting from the conference.  The Whitney R. Harris World Law Institute will cover the winner’s travel expenses to St. Louis, including airfare, accommodations and meals. 
 Please note that there will not be a participation certification given for competing in this essay contest.

REVIEW CRITERIA

  • Entries will be reviewed by a distinguished panel of impartial judges. 
  • Entries will be judged on the basis of originality, style and organization, quality of analysis and quality of research. 
  • Essays will be judged anonymously.

ESSAY QUESTION PRESENTED

The essay must address the following question:  Under what conditions may acts that constitute illegal use of armed force and that result in the widespread or systematic attack upon a civilian population be prosecuted as crimes against humanity by the International Criminal Court, pursuant to the Rome Statute.
Contestants are encouraged to consider the following and develop the arguments set forth in the description below:
In June 2010, a conference took place in Kampala, Uganda, to review the Statute that had been adopted in Rome to govern the International Criminal Court (ICC). It was agreed that the new Court would exercise jurisdiction over “the most serious crimes of concern to the international community as a whole.” Four categories of crimes were identified in article 5 of the Statute as falling within this jurisdiction: the crime of genocide, crimes against humanity, war crimes and the crime of aggression. However, the Court could only exercise its jurisdiction over the crime of aggression after a number of conditions had been fulfilled. One of the primary goals of the Review Conference in Kampala was to consider amending the Statute to add a definition of the crime of aggression and thereby close the gap in the ICC's jurisdiction. When the Kampala conference ended, a definition of aggression was adopted by consensus, now found in article 8 bis of the Rome Statute, but implementation of that definition was postponed until, at the earliest, 2017, meaning that the Court could not exercise jurisdiction over the crime of aggression until after that time.  Thus, what the Nuremberg Tribunal in 1945 had condemned as “the supreme international crime” cannot currently be prosecuted at the ICC.
Article 7 of the Rome Statute sets forth a definition of crimes against humanity, and lists as predicate acts, among others, “murder,” “torture,” “enslavement,” “rape” and “other inhumane acts of a similar character intentionally causing great suffering, or serious injury to body or to mental or physical health” (Article 7(1)(k)). No prior Security Council approval is required for prosecution of crimes against humanity assuming jurisdiction exists under article 13(a) or (c) of the Statute. Intent and knowledge are essential elements that must be proved, and pursuant to article 30(2), a person is deemed to have intent in relation to a consequence where either that person “means to cause that consequence or is aware that it will occur in the ordinary course of events.”
Thus, the question arises whether individuals responsible for the illegal use of armed force, knowing that their actions will result in the killing of large numbers of civilians, may be held accountable for crimes against humanity under the spirit and letter of the Rome Statute of the International Criminal Court.
