Seminar on Corporate Governance and CSR Compliance under Companies Act, 2013, and Release of Book titled "A Review of Laws Relating to Tourism in India"

The Legal Entrepreneurship Cell of ALS-N is hosting an event, the poster of which is attached. Company Secretaries and CEOs of several organizations will be arriving for this event, and will address the audience on issues including, but not limited to, Corporate Governance and Corporate Social Responsibility. 

A book edited by Major General Nilendra Kumar. titled A Review of Laws Relating to Tourism in India, will also be released at this meet. Those who have contributed to the book are invited to attend the function, and may bring guests as well. The contributors will have the opportunity to meet the Founder President of Amity University, Dr. A. K. Chauhan. The contributors will also receive a copy of the book, published by Thomson Reuters.  

This book is the first and only one of its kind, and contains articles on current aspects relevant to growth of tourism. The focus of this book is on medical, adventure and religious tourism. It is a compendium of all statutory laws concerning travel & tourism, and has been published by Thomson & Reuters.

The book is being released at 1100 hours on Wednesday, the 5th of November, 2014, at I-2 Moot Court Hall, Amity University, sector-125, Noida. Everybody who wishes to attend the event is welcome to do so.

Hindi Workshop



There exists a necessity to address knowledge of Hindi to those students who may not be very proficient in its use. Accordingly, Dr. S.K. Pandey, Asst. Professor has mooted an idea to hold special focus to the category of students indicated above. This would be as under:-

BASIC HINDI
Session on the above are proposed to be held on Tuesday, Thursday and Friday from 0915 – 0945 hrs. in Room No. 505. This is meant to provide working knowledge in Hindi to those students who may be wholly unfamiliar with the language.

BETTER HINDI
Session to upgrade Hindi skill, both written and verbal, would be held Monday, Wednesday at the same time in Room No. 505.

Workshop on Interview Preparation & Resume Writing

ALS, Noida is organizing a workshop on 'Interview Preparation & Resume Writing' for the 8th Semester. The workshop would be conducted in the Legal Aid Room:
 Session 1 : Preparation from the candidates end –conducted by Ms. Garima Wadhwa
 Session2: the employers perspective-conducted by Ms. Jyotica Bhasin(Partner, Bhasin& Bhasin)

 
The sessions would be taken up for two sections each:
 27 January –B.A. LL.b(hons) Section A and B for the first part of session; timings 1:30 pm onwards
 28 January- B.COM & B.B.A LL.b(hons) for the first part of session; timings 1:30 pm onwards.
 29 January- B.A. LL.b( hons) Section A,B for the second part of session; timings: 2:10 pm onwards.
 31 January- B.COM & B.B.A LL.b(hons) for the second part of session, timings: 2:10 pm onwards.


 It is expected that the above training program will contribute to better placements.

Students take pledge to use Right to Information

We are glad to inform that Amity Law School, Noida organised a guest lecture by Mr. Subhash Chandra AgrawalIndia's first and most successful activist of the Right to Information movement, which was truly one of the most significant events of independent, democratic India. The speaker holds the Guinness Record for maximum number of letters written to various newspapers highlighting governmental and administrative apathy. 

The welcome address was given by Maj. Gen. Nilendra Kumar, who spoke about the need to sensitize society on awareness of right to information and for actual changes to take place in our society. Already, sensitisation campaigns and awareness programs have been carried out in the law school through seminars, workshops, projects and Human Values Quarter etc. Moreover he exhorted students to take a pledge to use this right as they are the ones in whose hands the future of this country relies.


He spoke on the effective usage of "Right to Information Act" by the citizens of India adding tremendously to our knowledge on the topic. Stressing on the objectives of the RTI Act he stressed that the Act had tried to strike a balance between the interests of the information seekers as well as the information keepers. RTI Act is a very important tool to bridge the knowledge gap between the rulers and the ruled, the managers and the beneficiaries and between the producers/ distributors and the consumers. Inequality in knowledge is also responsible for social superiority and inferiority complexes reinforcing socio- economic divides. In the absence of free information, a distinct class of secret operators of power with a halo of unwarranted mystique and awe around them, emerges and behaves and operates as a superior race. RTI Act shall ensure access to information which is in the custody of public authorities. Mr. Agarwal opined that RTI Act had gone a long way to promote transparency and accountability in the working of every public authority and it was very important weapon in the armory of citizens to combat the arbitrariness of public authorities and the executive. It ensures for every citizen the enforceable right to question, examine, audit, review and assess government acts and decisions and helps ensure that these are consistent with the principles of public interest, probity and justice.

It was an interactive session where the esteemed speaker shared his experiences in the quest to achieve his goals and the students participated with full enthusiasm with their questions and queries. We hope that in the years to come RTI Act shall continue to be the beacon which illumines the dark corners of governmental structure. The legal Aid Society is extremely grateful to Mr. Agarwal for having come and delivering a very informative and insightful lecture on the RTI Act. Ms. Adita Kapoor Shah delivered the vote of thanks with a small token of appreciation to the esteemed speaker from the ALS family.

Prof. Bharat Karnad - Research Professor, National Security Studies at the Center for Policy Research, New Delhi delivers lecture on ' Geopolitics and Indian Strategy”

Prof. Bharat Karnad -Research Professor, National Security Studies at the Centre for Policy Research, New Delhi delivered a lecture on ' Geopolitics and Indian Strategy” at Amity Law School, Sector- 125, Noida

Maj.Gen. Nilendra Kumar- Director, Amity Law School, Noida welcomed the prolific speaker.

Prof.Bharat Karnad, during his lecture, outlined the geo political advantage that India enjoys being strategically located on the world map. He stressed that there is lack of efficient human resources in strategy planning department and opined that policy planning unit is sidelined in India whereas in other countries like Russia, China and Tokyo, policy planning is at the core.

He pointed out the reluctance of India and its people in spreading culture, fine arts and music beyond the boundaries whereas the imprints of other countries’ culture and traditions especially USA are clearly visible in Indian lifestyle and adding to the situation is India’s “Non- alignment Policy” which fits into India’s insular mindset and restricts India’s diplomacy.

Prof.Karnad remarked that India has lot of “manifested” advantages such as Human Resources,Frugal Engineering, therefore everybody wants to partner with India whether itis Japan, US or Australia.

Commenting on the bitter –sweet relationship shared between India and China, Prof. Karnad commented that China is a single minded country; everybody in China is imbued with the geo political vision to make China “Superior” to other countries. China, just like India, suffers lack of discipline and corruption. Dwelling further, the speaker said that China thinks of India very less in terms of military prowess whereas India, which should be cautious of China, remains too much pre-occupied with its petty neighboring countries including Pakistan, Nepal and Bhutan. India cannot even apprehend the danger right.

The speaker cautioned against the spreading influence of China in Srilanka, which is India’s back gate and therefore, a matter of concern for India. He suggested that India needs to become militarily pro-active and be assertive outside in the immediate neighbourhood and neighbourhood does not mean Pakistan or Bhutan but CHINA. Being “Great Power”is not an entitlement to be fought for. India should stop making itself dependant on other countries heedlessly since it is blessed with the bounty of nature.


The lecture was attended by over 100 budding lawyers who were deeply enriched with the insight provided by the speaker.

Pledge to Stop Violence against Women- Guest Lecture 31st July 2013

Amity  Law School Noida organised a guest lecture on  “Violence against Women” today on 31st July 2013 in F2 auditorium to sensitise and increase students awareness of violence against women in India today. The external guest speaker was Ms Winnie Singh, executive director from Maitri NGO, while Ms Manika Kantham, Law faculty in ALS Noida was our internal speaker on the topic. This guest lecture was organised by the Initiative for Gender Justice and Child Rights, a cell newly launched in ALS Noida, under the flagship of the ALS Centre of Law and Policy. 

The IGJCR cell has been the brainchild of Ms Mokshda Bhushan and Ms Manika Kantham, both assistant professors of law in ALS Noida, with the objective of imparting gender and children rights awareness to our law students and beyond as well as review gender specific laws and carry out other activities related to law and gender and children rights such as research projects, legal literacy and gender sensitization programs in the community and society at large.  

The welcome address was given by ALS Noida Director, Major Gen. Nilender Kumar, who spoke about the need to sensitize society on gender awareness and violence against women for actual changes to take place in our society.  Already, sensitisation campaigns and awareness programs have been carried out in Amity Law School Noida through seminars, workshops, projects and Human Values Quarter etc. Moreover he exhorted students to stop violence against women as they are the ones in whose hands the future of this country relies.

The Guest speaker, Ms. Winnie Singh (founder of Maitri India) talked about the need for respect and control of aggression in our society and in ourselves so as to stop any form of violence against women. She highlighted the different types of violence which exist in society, and how each one of us can forsake these forms of violence through controlling our own behaviour. Violence against women has been in our society for a long time, and it will only change if there is a genuine change in mindsets of people, even women themselves who contribute to violence against other women.  She further added that TOLERANCE for violence is one of the major causes for violence. If we stop tolerating violence against women, then only will violence against women will stop. She launched the “One million signature campaign” to stop violence against women, which Maitri NGO is supporting. This campaign is  a pledge undertaken by every person in India to stop violence against women through their own actions and show respect for women’s dignity and rights. Amity Law School Noida students showed their support to this noble cause by signing the pledge.

Ms Manika  Kantham from  ALS Noida highlighted the legal aspects on gender laws in India and highlighted the problems of violence tolerance in politics and media and propounded that sensitization on gender issues is a must for us to achieve genuine gender equality. She discussed the constitutional issues as well as various enactments in India and the UN charters. She made a brief presentation on gender violence by showing statistics in various forms and concluded that the effort to stop violence against women has to be a united effort of all. 


It was a highly interactive session where students from Amity Law School Noida participated with enthusiasm. Ms. Mokshda Bhushan delivered the vote of thanks while a small token of appreciation was given to Ms Winnie Singh from Dr Shefali Raizada, professor in ALS Noida.

Emerge successfully at the top in legal profession


To emerge successfully at the top in legal profession, the academic efforts would alone not suffice.  Excellence in legal career, more particularly in law practice requires a great deal of efforts in legal communication, court craft, advocacy skills, punctuality & time management, study of human nature etc.  These aspects are not part of any subject prescribed for LL.B degree. 

Dr. Arun Mohan, Sr. Advocate and an eminent author has very kindly agreed to instruct our students on above and related topics.  His individual success at the Bar, long experience and a capacity to impart knowledge makes him immensely suitable for the task.

A series of four lectures are planned in this regard.  These would take place on 1st, 6th and 7th August, 2012 from 3 to 4.30 PM.  The date of the fourth lecture would be intimated later.  All those interested to attend the lectures may register their names in the office of the Director, Amity Law School, Noida by Monday, 30th July, 2012.

Legal Training program on “ Legal Services Authorities Act, 1987 and Juvenile Justice System”

“The Legal Services Authorities Act and The Juvenile Justice (Care and Protection of Children) Act, were drafted in 1987 and 2000 respectively but some of us (members of the judiciary), even today after so many years, are not familiar with the various provisions of the Acts. It is not a reflection on any body particular as such, its just that we did not get an opportunity to deal with these enactments in detail to educate ourselves. Its a problem which I have faced all over wherever I have gone. I have seen that in remote parts of the country people are still not aware of what are the provisions of the Acts, what are their benefits and especially if those who are to implement these provisions are not aware of them then what about those people who are the beneficiaries?,” averred Honble Mr. Justice Altamas Kabir, Judge- Supreme Court of India while inaugurating the training programme on “ Legal Services Authorities Act, 1987 and Juvenile Justice System” organized by UP State Legal Services Authority under the aegis of National Legal Services Authority at Amity University, Sector-125, Noida.


Sharing his views and vast experience with the gathering, Honble Justice Altamas Kabir further said said that extensive programs of legal awareness have been regularly organized to make people aware of what is available to them and what needs to be implemented. He opined that its time that law fraternity realize the need to educate themselves in the nitty gritties of the two enactments. Dwelling on the lacuna hampering the smooth functioning of the Lok Adalats, Hon’ble Justice lamented the dearth of effective infrastructure to implement the provisions of the Acts and the reluctance of the people to come to Lok Adalats. At the same time, Hon’ble Justice revealed that the situation is not same all over the country. Therefore, in states which are densely populated like UP having so many districts, it is important to educate and familiarize people on the provisions of the Act.”

Expressing his views on “ Legal Services Authorities Act, 1987” during the inauguration of the training programme, Honble Mr. Justice Amitava Lala- Sr. Judge Allahabad High Court said, “the problems of “Noida” cannot be equated with the problems of “Son Bhadra” and problems of District Son Bhadra cannot be equated with the problems of the District of Lucknow. The aim of the Legal Services Authority is to render alternative judicial system, justice delivery is not restricted from the point of view of the Civil Custodial Court and Evidence Act. It depends upon fair play, it depends upon equity and when we think about equity then we think about morality, we think about the other natures of social justice which are required to be rendered through this process. It is not a dream, it was a dream at one point of time but by inclusion of Article 39 A and thereafter, promulgation of the Act and several amendments, we have come across a particular pavement from we shall be able to render justice.”

Welcoming the distinguished gathering, Dr. Ashok K Chauhan- Founder President, Amity Group said that its a historical day for Amity to host such a vast gathering of eminent members of judiciary. Dr. Chauhan remarked that the topics chosen for the training are very apt and relevant for making India a “Super power”. He averred that lawyers from no other country can supersede the intelligence of Indian lawyers. He shared five mantras for the budding lawyers to scale the pinnacle of success- “Creativity”, “Commitment”, “ Intuition”, “ Flexibility”, and “ Wisdom”. Dr. Chauhan, during the occasion, announced to start 3 Credit Course of “Legal Aid Services” for the law students of Amity University.

Sharing his views with the august gathering, Honble Mr. Justice Deepak Misra- Chief Justice, Delhi High Court said, “People who are associated with Lok Adalats or Juvenile Justice Systems must have concern, sincerity and commitment towards the litigants. They should ask themselves the fundamental questions- Do I really feel for the poor? Do I really have the commitment to argue the case of a marginalized person who cannot really afford? Students belonging to legal profession should restraint from condescending attitude, they should go to the villages, conduct studies, report and try to ameliorate the problems of the poor and marginalized sections of the society, acting as social activists”. He remarked that every case has a face to it therefore, he advised the judiciary to adopt humanitarian approach while dealing with people.

Mooting an important suggestion during the inauguration, Honble Mr. Justice Devendra Pratap Singh- Judge, Allahabad high Court said, “I have a rural background and nearly every month I visit my village, there are very small petty matters of the illiterate villagers for which they have to make rounds of the Tehseel very often. If the Authority can look into that I think it will render more human service to the litigants.”

Justice Syed Rafat Alam- Chief Justice, Allahabad High Court who could not make it to the occasion sent his message, which was read out by Honble Mr. Justice Devendra Pratap Singh. The message focusing on the Juvenile Justice read , “Rule 143 of the Central Juvenile Justice Model Rules 2007 specially mandates juvenile justice reports to ensure that juveniles in conflict of law receive free legal service and they can also deploy services of the students studying law for this purpose. The Juvenile Justice (Care and Protection of Children) Act 2000 has brought major changes in dealing with young offenders. It is a matter of satisfaction that the Government has addressed this problem by making various legislations yet the laws made require to be enforced effectively especially those pertaining to child labor, elimination of beggary, continuing education to children, prevention of child abuse and trafficking etc.

During the occasion, a Permanent “Amity Legal Aid Center” was inaugurated at Amity Campus, Sector 125, Noida by Hon’ble Mr. Justice Altamas Kabir, Judge Supreme Court of India & Chairperson, National Legal Services Authority (NALSA) in the presence of all the eminent judges present during the occasion including Hon’ble Mr. Justice Deepak Misra- Chief Justice, Delhi High Court and Justice Dilip Gupta- Judge , Allahabad High Court and many more. The centre shall work on all working days from 3 pm to 5 pm and shall deal with cases referred to it by UP State Legal Services Authority as well as cases brought before it concerning all sections of society. The establishment of the Legal Aid Centre in an academic institution is a new concept hitherto unheard of. Dr. Chauhan announced the opening of one “ Legal Aid Clinic” in each of Amity University ie in Haryana, Rathasthan and Gwalior.

The inauguration was followed by the training sessions on “Legal Services Authorities Act, 1987” and the different schemes of The National Legal Services Authority (NALSA)”, “Lok Adalat under Legal Services Authorities Act, 1987 and the National Legal Authorities (Lok Adalat) Regulations, 2009”and “Juvenile Justice System”

Eminent speakers for the sessions included Honble Mr. Justice Amar Saran- Judge, Allahabad High Court, Honble Mr. Justice Devendra Kr. Arora, Judge, Allahabad High Court, Lucknow Bench, Lucknow, Honble Mr. Justice Deepak Misra- Chief Justice, Delhi High Court Honble Mr. Justice Uma Nath Singh- Judge, Allahabad High Court Lucknow Bench, Lucknow, Honble Mr. Justice A. K Sikri-Judge, Delhi High Court Honble Mr. Justice Dilip Gupta- Judge, Allahabad High Court and other.

A documentary titled, “The Lost Childhood” was also screened during the training programme highlighting the various problems affecting the lives of the juveniles in our country.

The training programme was attended by over 250 Judicial Officers, 150 Lawyers and 1000 students from Amity Law Schools.

Proportionate Urbanization can help achieve desired GDP of 9% per annum” opines Dr. Isher Judge Ahluwalia- Vice Chairperson, Planning Board, Punjab during a lecture at Amity Law School

Dr. Isher Judge Ahluwalia – a well known economist and Vice Chairperson, Planning Board, Punjab and Member, National Manufacturing Competitiveness Council, Government of India visited Amity Law School, Amity University, Sector-125, Noida and delivered an interesting and stimulating lecture on “Challenges of Urbanization in India”.


Emphasizing on the role of urbanization and the role of Indian cities in the process of urbanization, Dr. Isher Judge Ahluwalia said that India is witnessing rapid urbanization, more and more people from rural India are moving to cities and predicted that India’s urban population will reach over 600 million by 2031. She revealed that during the last decade India’s GDP has grown by approximately 8 % p.a unlike 1980’s when it grew by just 5%. In 12th Five Year Plan, the aspired GDP is 9%. Dr. Isher further shared that 2/3 rd of India’s GDP comes from non- agricultural sector and it is estimated that by 2031, 75% of India’s GDP will come from non- agricultural sector.

She remarked that the urban sector will play a critical role in the structural transformation of the Indian economy and in sustaining the high rates of economic growth in coming decades. At the same time Dr. Isher expressed her concern over the fact that Indian cities are not ready to handle the overflowing deluge of population. Dr. Isher shared that 50% of China’s population, 75% of Mexico’s population and 80% of Brazil’s population live in urban areas whereas as per the latest consensus, only 30% of urban population live in urban areas. That 30% of urban population also face a dearth of infrastructural facilities. Therefore, there is an immediate need to upgrade urban infrastructural facilities.

Dr. Isher stressed that urbanization is possible only by strengthening the framework of governance, synergizing urban and rural sector, addressing the needs of urban poor (which is 26% of the population living in cities) and increasing the investment in urban infrastructure deficit in terms of good roads, transport, proper sanitation, street lights, water management, solid waste management etc.

She averred that India has to aspire for broad based and inclusive growth and even if the economic growth momentum is not accelerated, it has to be sustained at 8%.

Quoting the “Report on Indian Urban Infrastructure and Services” prepared by a High Powered Expert Committee (HPEC) under Dr. Isher Judge Ahluwalia, the eminent speaker said that for efficient urbanization, India’s Urban Local Bodies (ULBs) need to be strengthened as local self-government with clear functions, independent financial resources and autonomy to take decisions on investment and service delivery. State governments should provide an enabling environment for ULBs to discharge their enhanced responsibilities, they should set up State Finance Commissions (SFC), which will lay down the rules of funding to ULBs. Only then can they augment the urbaninfrastructure base, provide improved quality of services on a sustainable basis to their residents, and contribute to the growth momentum of the Indian economy.

Dr. Isher suggested that an amendment is needed in the Constitution. Urbanization needs a great deal of governance rather than just investment. Government of India has to play a pro- active role, urbanization is just not State Government’s work. Government of India has to make an environment where State Governments can function efficiently and effectively. In view of the importance of urban infrastructure for economic growth and inclusion, the Government of India and state governments has to work in tandem.

The lecture was followed by an interesting question and answer session wherein the budding lawyers from Amity Law School, Amity University posed a volley of questions to the eminent speaker.

Release of Book : Law, Poverty & Development


“More than 76 % of the Indian large population is below the poverty line. Despite the rise of per capita income there exists vast economic and social inequality. India’s dense population is one of the greatest challenges on its way to progress and development. However this dire situation can be overcome if coercive efforts are put in by the public and private sector to bridge the gap between the affluent and marginalized of our society. Even the private sector needs to engage itself in more social business and a company law should be introduced for the corporates to adopt rural villages a part of CSR.” said Hon’ble Dr. M. Veerappa Moily, Union Minister for Corporate Affairs during the release of the book “Law Poverty and Development” authored by Maj. Gen. Nilendra Kumar, Director, Amity Law School, Noida and Advocate Mr. Kush Chaturvedi at Amity University Campus, Sector -125 Noida. Dr. Moily further added that the population rise in India can become the demographic dividend in another thirty years and the population can be transformed into the asset of the country. Poverty should not be taken for granted in India and per capita income of any country should be judged with the way it handles its poverty” averred Dr. Moily. 

Delivering the key note address during the book release function Justice Mr. K.S Radhakrishnan, Judge Supreme Court of India said “The constitution of India is one of the best Constitutions in the world as it has numerous provisions to safeguard the interest of the weaker section and minorities in the forms of various National Commissions. However the challenge lies in effectively implementing all of them and the optimum implementation of these provisions is the key to holistic progress of the country. Therefore every citizen should engage in contributing to social equality in whatever way possible in order to sew the thread of equality and fairness in the Indian Social fabric. He averred that social service should be made compulsory for the youth to serve the poor and Socio Economic Legislations like Right to Food and Right to Shelter should be introduced to elevate the living conditions of the marginalized.Wishing great success to “Law Poverty and Development” and hoping that it will ignite a flaming sense of responsibility in India’s legal system to eradicate the chronic problem of poverty from the country Dr. Ashok K Chauhan, Founder President, Amity Group said “In a world, where poverty and marginalization of vulnerable groups are on rise, it is necessary to stress on the particular importance of the right to development”. While sharing with the audience the concept and objective of the book Maj. Gen. Nilendra Kumarinformed that Law, Poverty and Development is one of the subject papers prescribed by Bar Council of India for the LL.B syllabus in Bar Council of India rules and this book is a wholesome effort to discuss the law relating to poverty, which have been covered in four distinct modules of Understanding poverty and development, Constitutional guarantee for the poor, Criminal justice system and the poor and Impoverishment of women, children and disabled persons. He further said “the subject of income distribution is not any separate from the functioning of Law and Order. Poverty is a problem of international human rights law. Therefore, poverty under International Human Rights Law can be seen as violation of civil, political, economic, cultural and social rights, which requires a legal commitment from each of the responsible actors and entitles the poor people as the right holders to pursue their rights.” Also present during the book release function were the Mr. Kush Chaturvedi, Co Author of “Law Poverty and Development”, Dr. Manish Arora, Director, Universal Law Publishing Co,HOIs, faculty and students from various institutions of Amity along with other distinguished guests.The release of the book was followed by the felicitation of the esteemed guests by Dr. Ashok K Chauhan.The other books authored by Maj. ‘Good Governance’ and ‘Sustainable Development ‘can only be assured by rule of law opines H.E. Mr. Shekhar Dutt, Governor of Chattisgarh at ALS


Amity Law School organized a Lecture on “Law and Good Governance” by H.E. Mr. Shekhar Dutt, Governor of Chattisgarh at the Amity University Campus, Sector – 125, Noida.

While addressing the august gathering, Maj. Gen. K. Jai Singh, VC, Amity University Uttar Pradesh, said, “the young students of today are the future of law and administration of the country. The loopholes are that administration of justice is lagging and equality of law is yet to be practiced. Law is an end of justice. So it should not be so technical that justice is sacrificed. There is misuse of law on the other hand by those who hold the authority of law which need to be regulated. 

In his welcoming address Maj. Gen Nilendra Kumar, Director, Amity Law School spoke on the importance of Law and Good Governance and it’s relevance for perfect administration in the country. The role of good governance is increasing with the development and expansion of the country. Extremism and violence are constant threat to the Indian polity. Therefore good governance is of prime importance. 

Delivering the special lecture on ‘Law and Good Governance’ H.E. Mr. Shekhar Dutt, Governor of Chattisgarh and former Deputy National Security Administrator, shared valuable information as to how to make the country socially, politically and economically developed in the world. He said, “I consider Law – as something which sustains and holds the people together and binds them into one country. No country can carry on and develop without having a rule of law. Being Indians, we know that ours is a country of diversity. Each and every state has its own culture, language, customs, festivals and more than one religion. It is our constitution and law that assures them of equality, justice and binds them into unity. Looking at law as a controlling mechanism devised to maintain order among the people only is a myopic view. Maintenance of law and order is only one of the objectives of law. We have seen in India that that social reform like abolition of Sati pratha, equal rights to women, prevention of child marriages and such social reforms have been made possible by enacting relevant laws. Similarly, welfare measures like protection of rights of persons with disabilities, helpless senior citizens, poverty, protection of rights of labour and similar social problems were also addressed by enacting laws. Democracy is a vehicle of change and development as well as foundation of governance.” 

Mr. Dutt said, “we cannot ensure development, welfare and reforms to happen only by enacting laws. Honest and sincere implementation of law of the land is most important. ‘Good Governance’ and ‘Sustainable Development ‘can only be assured by rule of law. Our country has a federal structure but it is unitary in spirit. Many development or welfare related issues like education, welfare of labour are in the concurrent list. However, when it comes to the issue of development and welfare like rural development and health, Union Government comes to the aid of the state and helps by formulating schemes and provides funds for the same even when such subjects in the state list. This is possible only because of the unitary spirit of our Constitution.” 

H.E. Mr. Shekhar Dutt, Governor of Chattisgarh concluded his lecture by saying that Good Governance requires accessibility, accountability, predictability and transparency. And to ensure all this ‘independent Judiciary’ is essential. The legal system has to be accessible also. Right to Information Act has brought revolutionary changes in the administration and also in the awareness level of the people. So many cases of misuse of power and financial irregularities have been brought to light by the whistleblowers using ‘Right to Information’. 

Dr. Ashok K. Chauhan, Founder President, Amity Group highly appreciated the lecture of H.E. Mr. Shekhar Dutt on ‘Law and Good Governance’. He said, “Good Governance can lead India to be a Super Power. By 2020 our population will comprise of 30 to 35 percent of young people which will to help to change the world. This can happen only with Good Governance. Mr. Dutt has given us an action plan to take India into new heights of success and to fulfill the mission India to lead the world. Moral values and ethics also play a vital role in the progress of a country, affirmed Dr. Chauhan. 

The lecture was attended by Dr. B. Shukla, Pro-VC (A), Amity University Uttar Pradesh, several Directors, Head of Institutes and hundreds of students of Amity Law School.
